法律文书翻译生态环境中的译者主体性研究

On the Translator's Subjectivity in Law Document Translation Ecological Environment

以生态翻译学为理论基础,以法律文书及其翻译为语料,旨在研究置身于法律文书这一特殊翻译生态环境下的译者主体性。研究表明译者主体性的发挥受到翻译生态环境的制约,受到译者自身能力的限制,进而影响译文的质量和译者自身的生存。法律文书翻译是发生在法律制裁者、译者和法律适用者之间的交际过程,译者处于整个翻译活动的中心地位,其主体性的发挥决定了翻译质量的高低和翻译文本的生存。因此,法律文书翻译中的译者既要具备一定的能力素养,又要打破翻译生态环境的制约,进行适应性选择和选择性适应,为译者和译本获得适者生存的权利。

Based on the theory of ecological translation , this research takes law documents and their translations as the corpus , and aims to study the translator ’ s subjectivity in the special ecological environment of law documents .Studies have shown that the translator subjectivity is restricted by translation ecological environment and translator ’ s ability, thus further affects the survival of the translation and the translator .Law document translation is a communicative process among the law maker , the translator and law applicants in which the translator occupies the center whose subjectivity decides the quality and survival of the translation .Thus, the law document translator is necessary to have the ability of literacy and to break the constraints of translation ecological environ -ment.He/she should strive for the survival of the translators and the translation via adaptive selection and selective adaptation .
