基于制度与技术约束的机械专利规避设计 被引量:13

摘要 为满足专利规避设计的需求,以机械类专利为例,首先从专利制度的角度分析了设计约束条件,提出构建机械产品专利权利范围图,建立基于功能裁剪的规避路径集;其次,从现有技术约束的角度,对机械产品核心专利的识别及竞争对手的专利布局进行分析,建立专利规避策略,同时提出相应的基于发明问题解决理论工具的解决方法,获得规避设计方案,并基于制度约束对其进行评价,确保专利规避成功;最后,选择原型机械产品的专利进行了规避,验证了所提专利技术与制度约束的专利规避方法的有效性。 To satisfy the requirement of patent design around,the design constraint conditions were analyzed by taking mechanical products as the example,the patent rights scope figure of products was proposed and the around route muster based on function tailor was established.From the present technological view,the central patent identification of products and competitors’ four dimensionalities patent portfolios were elaborated to build strategies of patent around.Based on analytical and solution tools of TRIZ,the corresponding solution methods aiming at different problems were proposed,and the around design projects were obtained.To guarantee the success of patent around,the projects were evaluated by system constraints.The example patent of mechanical product was chosen as target to design around,and the proposed patent technologies and the patent system constraints were verified reliably and effectively.
