当前,由于在规范和理论层面对检察权的性质和地位界定模糊,客观上导致实务层面检察权全面履行的不能,亟须在公法视野下立足于国家权力划分的,提炼检察权的基石范畴,明晰检察权的内涵和外延,实现检察权的宗旨与职能的耦合。

At present, the vague definition of the nature and status of prosecutorial power at the normative and theoretical level, has objectively led to the failure of fully implementing prosecutorial power at the practical level, so it is urgent to refine the cornerstone category of prosecutorial power, clarify the connotation and extension of prosecutorial power, and realize the interconnection between the aims and functions of prosecutorial power, based on the division of different powers from the vision of public law.
