农村空闲宅基地处置的现行规定分析及调整探讨

Rural Idle Residential Land Regulations Analysis and Their Adjustment Investigation

目前农村空闲宅基地问题突出,处置空闲宅基地的规定存在诸多问题,而学界鲜有对空闲宅基地处置规定进行分析的文献,研究空闲宅基地处置的政策规定具有重要意义。本文采用规范分析法和文献资料法对空闲宅基地处置的现行规定以及其出现的原因进行了深入分析,在此基础上提出了对现行规定进行调整的政策建议。研究发现目前规定较为杂乱且存在不合理的现象,不能真正解决空闲宅基地问题。在对空闲宅基地进行处置时,要区分农村空心化和"一户多宅"两种情况,并分别出台相应的政策规定,采取宅基地转让和宅基地退出机制分别对空闲宅基地予以处置。

At present, there are some serious problems in rural idle residential land regulations, but there are little papers about it. Studying rural idle residential land regulations has significance for their improvement. Based on normative analysis and documents analysis, this paper discussed present regulations and the reasons of their formulation and then put forward some suggestions about how to improve the regulations. The study showed that existing regulations are jumbled and there are some unreasonable phenomena. Different regulations should be implemented when facing rural hollowing and facing multi-homesteads for one family, and rural idle residential land should be either transferred or exited.
