宪法生态主义视野下城市发展的法治保障

Legal Protection of Urban Development from the Viewpoint of Constitutional Ecologism

城市化是国家现代化的标志之一,城市发展的重要意义越来越突出。但是,到目前为止发生在城市这个特定环境内的事件和事故,对传统概念上的城市发展思路、战略,以及法治保障提出了挑战,表明城市发展同样需要转型。宪法生态主义作为制度化、规则化的资源与权利的配置方式,为城市发展确立了最高原则,即人与自然之间、人类社会内部的和谐,目标是最大限度地保证人类与生态环境的可持续性发展状态。宪法生态主义视野下城市发展的法治保障意味着在立法观念上要以"人类和自然生态共同利益"为核心,法律规范以促进人类与自然环境之间和谐关系为目标,要有对破坏自然生态的城市发展和城市规划的设计、方案进行严格惩处的法律责任制度。

As urbanization has become one of the symbols of modernization, the research of urban development becomes more and more important. However, events and accidents happened in some cities have challenged the traditional strategy and the legal protection of urban development. This shows that it is necessary to began urban-developing transformation. As an institutionalized allocation scheme of rights and resources, Ecological Constitutionalism has settled the supreme principle of urban development, i.e. the internal harmony between human beings and nature as well as inside human soci- ety itself. It targets to ensure sustainable development of human beings and ecological environment to the largest possible degree. Legal protection of urban development from the viewpoint of Ecological Constitutionalism requires us to see the mutual interests of human beings and natural ecology as the core essence, and to set the promotion of the harmonious rela- tionship between human and environment as the ultimate goal. It also requires us to impose legal responsibility on the ur- ban developing and urban planning designs which might harm natural ecology.
