摘要
大中型水利水电工程建设项目需要临时使用土地的,由县级以上人民政府土地主管部门批准[1]。临时用地不改变土地使用性质和土地权属,一旦使用目的达到后就及时归还土地于土地所有人,并不是长期使用土地。但临时用地毕竟是一定期限内占有和使用土地,并对土地和土地上的附着物可能带来损害,因此临时用地手续的批准和使用完毕后的交付很难实现。本文就临时用地主要涉及经济补偿合同和使用后土地的恢复等问题进行探讨。
The medium-sized water conservancy and hydropower construction projects require a temporary use of land,which approval by land administration department above the county level of the people' s governments. Temporary land does not change the nature of land use and land tenure ,return the landowner after using ob- jective was achieved in a timely and not the long-term use of the land.But after all, temporary land within a certain period of possession and use of land, and the land and attachments on the land may bring damages ,so the delivery is difficult completed after using objective was achieved.This paper mainly involves financial com- pensation for temporary land contract and restore land and other issues were discussed after use.
