网络舆情有限治理的法治化:秩序建构与权利保护的统一

The Limited Governance Legalization of Network Public Opinion: the Unity of Order Construction and Rights Protection

网络舆情是信息时代公民享有的言论表达权和批评监督权在网络空间延伸的具体表现。网络舆情治理须兼顾互联网秩序的建构和公民权利的实现,应在借鉴域外经验的基础之上,调整治理思维,确立有限治理的基本原则,大力推进网络法治,通过完善法律体系,界定网络有害信息范围,制定正当程序限制,转型政府治理模式,协调公民权利诉求与政府秩序价值取向的冲突,实现网络空间秩序与权利保护的法治统一。

Network public opinion is the specific manifestation that citizens have the rights of expression,and criticism and supervision in the information age over the network space. The management of network public opinion must balance the construction of the internet order and the realization of the civil rights. Meanwhile,on the basis of foreign experience,some measures should be taken： adjusting the governance thinking; establishing the basic principles of limited governance; vigorously improving the network law; improving the legal system to define the scope of harmful network information; setting up proper procedure limits;transforming governance model; coordinating the conflict between civil rights and value orientation of government order; finally realizing the legal unity of the network order and rights protection.
