摘要
体育赛事转播权是指有关体育组织或赛事的主办者对体育赛事媒体转播的控制权,源于体育赛事组织者在赛事组织上的投入和贡献。电视媒体在转播体育赛事的过程中,如果转播的画面在衔接上具有一定的创造性,即可构成作品。在网络媒体未经许可转播该作品时,根据其转播形式的不同,可能侵犯电视媒体享有的不同权项的著作权。但是,从邻接权的角度,电视媒体不享有网络转播权和通过技术设备向公众播放权。
The broadcasting rights of sporting events is a controlling power of the sponsor of sporting events to the media broadcasting of sporting events.This type of right originates from the contribution of the organizers of sporting events to the organizing behavior.When the TV media is broadcasting sporting events,if the screens have some creative characteristics,it will be works.If,without permission,the network media broadcasted the work,it might tort different types of copyright.However,from the perspective of neighboring right,TV media doesn＇t want to have internet broadcasting right and the public broadcasting right through technical equipment.
