摘要
在我国,随着社会阶层的不断分化,劳动者也因其与用人单位的关系不同而分为不同层级,但并非所有的劳动者相对于用人单位而言都是弱势群体。基于对域外经验的借鉴及对契约自由原则和劳动合同法的私法属性的考量,本文从劳动者与用人单位的关系出发,提出劳动关系应当分层调整,应对不同层次的劳动者实行不同的管理方式,以加强劳动法对企业高级管理人员的规制,维护普通劳动者的合法权益,平衡用人单位和劳动者的利益,构建和谐稳定的劳动关系。
In our country,with the constant division of the social stratum,the laborers are also divided into different levels according to the different relations with the employing units.As for the employing units not all the laborers are the vulnerable groups.Based on the reference from the foreign experience and the private law property's consideration of the contract freedom principle as well as the labor contract law.The paper,starting from the relations between the laborers and the employing units,holds that the labor relations should be adjusted by the layer and carry out different management modes for the laborers who are in the different levels to strengthen the regulation of the enterprises' high-ranking managers from the labor law,to maintain the legitimate rights and interests of the ordinary laborers,to balance the benefit of the employing units and the laborers and to construct harmonious and stable labor relations.
