城乡统筹社会保障的法理分析

The Jurisprudence Analysis on the Social Security of the Urban-rural Integration

建立城乡统筹的社会保障制度,是法的目的价值的要求,符合法的终极目的——公平的要求。国家有义务为社会成员提供社会保障。本文通过对统筹城乡的社会保障法的渊源和社会保障立法的基本原则进行分析,认为建立城乡统筹的社会保障制度,要从社会保障权利、立法理念、立法体系等方面着手。

Establishing the social security system of the urban-rural integration is the demand of law＇s goal value,and is accorded with law＇s ultimate goal-the demand of fairness.The country is obliged to provide the social members with the social security.The paper,through the analyses on the social security law＇s origin of the urban-rural integration as well as the basic principles of the legislation for the social security,holds that establishing the social security system of the urban-rural integration needs to start from perspectives of the right to the social security,the legislative idea and the legislation system and so on.
