从经济法的角度审视我国土地征收的法律制度

随着城镇化的发展,土地征收问题日益凸显,各方的矛盾也日益尖锐,如何权衡国家、集体、农民三者之间的利益关系,成为我国经济发展进程中必须面对和亟待解决的问题。目前,学术界关于土地征收制度的探讨多侧重于对土地征收公共利益目的的考察研究,并把土地征收行为多从行政法的角度进行研究。而本文意在以经济法为视角,简明地归纳我国土地征收的基本理论,深入分析我国土地征收制度的现状及问题,借鉴国外的相关理论和实践经验,重新分配国家、集体、农民之间的权利义务体系,运用土地政策发挥土地资源的宏观调控功能,根据市场价值设计土地征收补偿制度,完善被征地农民社会保障法律制度,在宏观经济调控的基础上提高社会发展的整体水平。
