摘要
基于物权基本特征和原则,用标的物尚不存在的商品房买卖合同为借款合同提供的"担保"并不是习惯法担保物权或者法定的担保物权,也不发生流质契约效力,而是一个附解除条件的代物清偿合同。
Based on the basic property and principle of real right,the'guaranty'using commercial house contract with nonexistence of the underlying asset to get loan contract is not habitual law to conduct guaranty of real right,is not legal guaranty of real right,does not have the effect of fluidity contract but is a real settlement contract with resolutive condition.
