构建我国环境法律有效实施评价指标体系的思考

The Construction of Evaluation Index System of the Effective Implementation of Environmental Law in China

环境法律有效实施评价体系的建立,是"量化法治"的部门法实践,对环境法律的有效实施有科学的引导功能、反思功能和预测功能;同时,还可以为引导社会舆论正确认识和评价环境法律有效实施状况,为推动社会和谐发展起到良好的作用。我国应从科学性、典型性、可操作性和可比性等原则出发,构建定量指标与定性指标相结合的环境法律有效实施评价指标体系,对环境行政执法、环境司法、环境法律监督、环境法律文化、环境法律服务、群众对环境法律实施的满意度等6个法治领域予以客观评价。

The construction of evaluation index system of the effective implementation of environmental law,which is the ＂quantification of the rule of law＂ in the department of law, has the scientific guidance function, the reflection function and the forecast function to the effective implementation of environmental law. At the same time, it can also guide the public opinion correctly understand and evaluate the effective implementation of environmental law, and play a good role to promote the harmonious development of society. We should start from the principle of scientific, typical, operability and comparability, to be an objective evaluation of the environmental administrative law enforcement, environmental justice, environmental law supervision,environmental law culture, environmental law service, the people＇s satisfaction of the implementation of environmental law and other six areas.
