“5.2”庆安案件处置对民警现场依法有效使用武力的启示

Reflection on Effective Lawful Application of Force by On-spot Police——A Case Study of the Disposal of“5.2”Qing'an Incident

执法民警现场处置警情时,在武力手段运用上要做到合理、合法、有效。以"5.2"庆安案件处置为例,可知"5.2"庆安案件在警情处置中虽然执法程序合情、合理、合法,形势评估到位,判明情况准确,民警应急射击技能过硬,但也存在警力配备滞后,警械使用技能欠缺等问题。要解决此问题,必须转变观念,敢于合理、合法、规范、有效的使用警械、武器,依据警情变化确定武力手段的运用等级,加强警械、武器的配置与技能训练。

Force must be applied reasonably, legally and effectively by police when enforcing the law on the spot. This paper fully affirms that the enforcement procedure is reasonable, lawful and effective, the situation assessment is appropriate, the circumstance judgment is accurate, and the police emergency shooting skills are perfect in disposal of ＂5.2＂ Qing＇an incident. But there are still some problems such as backward of the provision of police force, short of police instrument using skills and so on. In order to solve this problem, the stereotypes must be broken so that on-spot police can use their apparatuses or weapons in a reasonable, lawful,effective and standardized manner. It is pointed out that the force degree is determined pursuant to the seriousness of the situation variation and it is also put forward that rigorous training must be strengthened on the techniques in using police apparatuses and weapons.
