弗里德曼的法律制度研究述评——研读《法律制度:从社会科学角度观察》有感

Review on Legal System Research of Friedman——Impression on legal system:a social science perspective

在社会变革日益加速的今天,传统的法律研究视角已经不能满足要求。弗里德曼在实证主义的引领下,跳出法律自身的框架,构建了至今仍被广泛引用的法律文化模型,从社会科学的角度观察法律,全面阐述法律制度、法律行为、社会法律理论以及法律文化等内容。本文在研读《法律制度:从社会科学角度观察》一书的基础上,对弗里德曼的法律思想进行了总结、概括,希望给大家呈现弗里德曼的主要法律思想。

Traditional legal research perspective has been unable to meet the requirements of today＇s ever-accelerating social change.Under the guidance of positivism,Friedman,out of the framework of the law,constructed a legal culture model which is still widely cited today.He observes the law from the perspective of social science,comprehensively elaborates the legal system,legal act,social and legal theory,legal culture,etc.Based on the study of legal system：from a social science perspective,the paper summarizes Friedman＇s legal thoughts hoping that his main thoughts are rendered to the readers.
