论新时期医疗纠纷防范对策——以《医疗纠纷预防和处理条例》为视角

On the Countermeasures of Medical Disputes in New Era——From Perspective of Regulations on Prevention and Treatment of Medical Disputes

我国推行市场化的医疗卫生体制导致医疗纠纷激增,成为我国社会的焦点问题。针对医疗纠纷产生的原因,依据《医疗纠纷预防和处理条例》的相关规定,应从加强医务人员的职业素质、强化医疗机构管理体制、健全医疗收费制度、建立医患沟通机制、重构医患之间的信任机制、依法规制新闻媒体、推行医疗卫生体制改革以及完善医疗卫生法律制度等方面,提出预防和处理医疗纠纷的措施和建议。这对有效维护医患双方的权益,构建和谐的医患关系,促进新时期医疗卫生事业健康有序的发展,具有十分重要的意义。

The implementation of market-oriented medical and health system in China has led to a sharp surge in medical disputes,which has become the focus of our society.According to the regulations on the prevention and treatment of medical disputes,measures and suggestions to prevent and deal with medical disputes aiming at the causes of medical disputes should be introduced which include strengthening the professional quality of medical personnel,strengthening the management system of medical institutions,improving the medical fee system,establishing the doctor-patient communication mechanism,rebuilding the trust mechanism between doctors and patients,regulating the news media according to law and promoting the reform of medical and health system and improving the medical and health legal system.It possesses significant meaning of effectively safeguarding the rights and interests of doctors and patients,building a harmonious doctor-patient relationship and promoting the healthy and orderly development of medical and health undertakings in the new era.
