软法视野下的《公共图书馆服务规范》--兼论我国图书馆立法的必要性

Public Library Service Standards from the Perspective of Soft Law: On the Necessity of China's Library Law

在当代社会公共治理领域,软法作为国家法的补充正在发挥着越来越重要的作用。当前,我国公共图书馆管理领域还存在比较严重的国家法律缺失问题,而作为软法的《公共图书馆服务规范》则在公共图书馆管理方面发挥了重要的调节作用。《公共图书馆服务规范》的出现弥补了我国现有图书馆立法领域的不足,起到了替代法的作用。软法应对与硬法治理相结合是今后我国公共图书馆建设方面的一个必然趋势,在此情势下,我国需要尽快出台"图书馆法"。

Soft law is playing more and more important role as assistance of state law in the modern social public ruling field. Now,China＇s public library service field is still lack of state law, while the Public Library Service Standards plays great role. The appearance of the Public Library Service Standards has covered the shortage of China＇s enforcing enactments in library governance and has worked as a surrogate. The rule of soft law as well as hard law is to be the trend of China＇s public library establishment. The Library Law should be enacted as soon as possible in such a situation.
