党内法规与国家法律的协同问题研究

党内法规与国家法律的关系是当前法治建设的重大问题。早在改革开放之初,邓小平同志的"没有党规党法,国法就很难保障"的论断揭示了两者关系的重要性。十八大以来,"注重党内法规同国家法律的衔接和协调"受到全党关注。应把两者关系提高到协同的高度认识,在对两者协同的内涵进行分析的基础上,论述实现党内法规与国家法律协同的重要意义,分析制约党内法规与国家法律协同的主要问题,提出构建党内法规与国家法律有效协同机制的对策。

The relationship between the internal regulations of the Communist Party of China and the national laws is a crucial issue of the legal construction. Deng Xiaoping＇s judgment that the national laws cannot be guaranteed without the internal laws reveals the importance of the this relationship. The connection and the cooperation of the internal regulations and the national laws has become a rising concern since the Eighteenth National Congress of the Communist Party of China. In this paper, the relationship between the two has been raised to the height of the cooperation. Based on analyzing the connotation of the cooperation between the two, this thesis discusses the significance of realizing the cooperation of the internal regulations and the national laws, studies the restrict factor of the cooperation of internal the countermeasure of constructing the cooperation of internal regulations and the national laws, and proposes regulations and the national laws.
