互联网时代下的数据保护

Data Protection in the Era of the Internet

随着以互联网为代表的新兴技术的高速发展,激增的数据在推动公共辩论、日渐需要信息的知识经济以及实现自我价值等方面发挥着重要的作用。本文在检视数据以及数据流自由流通的价值的基础上,从国内外数据保护的近况,分析数据激增背景下的数据保护模式。

With the development of the Internet,the explosion of data play an increasingly important role in promoting public debate,information of knowledge economy,realizing self- actualizationn,and so on. This paper is to examine the value of data and the data freedom on the basis of recent data protection status from inside and outside country,especially the cases of United States courts decided data as speech. Under the background,through the analysis of the protection of data,we hope for providing a new way of thinking of freedom of data protection in China.
