Based on the characteristics of service industry, under the framework of Incomplete Contracting Theory and Transaction Cost Theory, this paper analyzes the theoretical mechanism about the impact of incomplete contract on service industry agglomeration. The contract execution efficiency has a positive effect on service industry agglomeration, and contract-intensive service industry tends to have a higher degree of agglomeration in a district with higher contract execution efficiency. The empirical research is done with the use of data from 16 kinds of service industry in 30 provinces in China. The results show that contract execution efficiency has a significant positive effect on service industry agglomeration. However, due to the structural flaws of"attaching more importance to tangible input than to intangible input"in China's service industry,as well as the"crowding-out effect"and "substitution effect"of the input from the developed countries upon China under the value chain system of global service industry,China's service industry has been low-locked in global value chain, which has restricted the contract-intensive service industry from clustering in the districts with higher contract execution efficiency. The above results remain robust in case the variables such as market scale, human capital, physical capital, openness, etc. are under control.
