从运动到法治:新中国成立以来反腐败斗争的模式演进及其路径选择

From Campaign to Rule of Law: The Mode Evolution and Path Choice of Anti-corruption Struggle since New China's Foundation

新中国成立以来我国反腐败斗争经历了运动反腐模式、权力反腐模式和制度反腐模式的变迁,不同模式之间的更替是历史选择的必然性,也折射出由"人治"走向"法治"的反腐败理念的转变。从历史发展的视角,高度总结过去各个时期反腐模式的演进及其实践效应,并从制度反腐的学理基础和现实诉求的层面阐述中国反腐败步入新常态的必然指向,最后阐述中国反腐败斗争最终必然走向法治,在此基础上提出相关的具体对策,旨在为我国的反腐败斗争工作提供一定的借鉴意义。

China has witnessed great changes in anti-corruption mode since its foundation from anti-corruption through campaign to anti-corruption with power restraint and then to institutional anti-corruption, which are the inevitable result of historical choice and also reflect the change in the anti-corruption ideas from ＂rule of man＂ to ＂rule of law＂. In the perspective of historic development, this paper summarizes the evolution of anti-corruption mode in different periods and their effectiveness in practice, expounds the inevitability of China＇s institutional anti-corruption to become a New Normal from its theoretical basis as well as practical need and believes that it is essential to adopt the rule of law in China＇s anti-corruption struggle, based on which the paper advances some countermeasures to provide certain reference to China＇s anti-corruption work.
