案件质量评估体系的理论反思与前瞻

Theoretical Reflection and Prospect of Quality Evaluation System of Case

虽然司法实务界对案件质量评估体系暴露出的指标设置不合理、过于机械化的运行以及难以真正衡量法官工作业绩等问题进行了实证剖析,但仍缺乏对该制度进行理论上的审视及其强大生命力证成。以定性和定量相结合方法、诉讼消费者理论以及管理人本理念为视角对案件质量评估体系进行理论检讨会发现,其本身还具有巨大的完善和规范空间。建立科学合理的案件质量评估体系应处理好三对基本关系,即指标数据虚与实的关系、指标设置封闭性与开放性的关系以及质效评估与业绩评价的关系。

Although the empirical analysis of judicial practice on the system of case quality evaluation has revealed the index set unreasonable, mechanized operation and is difficult to measure the performance and other issues, there is still lack of the system theoretically look and strong vitality review.From the perspective of the combination of qualitative and quantitative methods, the theory of consumer litigation and management of humanism idea,the system of case quality evaluation theory review will find itself has a huge space to improve and standardize .To establish scientific and reasonable system of case quality evaluation,it should deal with three pairs of relationships., namely,index data of virtual and reality, the index set closed and open ,and last relationship between quality and efficiency evaluation and performance evaluation.
