Law and Social Risk Control

风险社会与社会风险,二者含义虽有差别,但在应用中却不是完全割裂的。社会风险是由其内因和外因双重作用形成的。法律对社会风险控制的价值权衡要在综合考虑权力与责任一致、预防性与风险控制、效益与成本结构优化、兼容性和尚法性的文化培育等原则的基础上,实行风险控制的权责一体化、注重立法理念的更新、完善社会保障机制的建设,加强法治意识的宣传等。

The meaning of the risk society and the social risk is different,but they are not completely separate in the applica-tion. The social risk is formed by the internal and external factors. The value of law on social risk control should be basedon the principles of power and responsibility,prevention and risk control,benefit and cost structure optimization,compatibili-ty and cultural cultivation. So we should pay attention to the update of the legislative concept,perfect the construction of so-cial guarantee mechanism,strengthen the rule of law consciousness of publicity system.
