全球视阈下新能源专利短期申请制度的协调与统一

摘要 新能源专利短期申请制度是促进和激发绿色技术创新的关键手段。然而,由于各国对这一制度在审查标准、审查对象范围上的差异,导致其实施效果不佳,难以实现其原定目标。因此,从促进全球范围内新能源专利的许可和实施出发,有必要扩大审查对象范围、明确审查标准,同时增加合理的程序限制,提高审查效率,并建立全球绿色专利高速路,为各国知识产权管理部门提供统一的示范蓝本,从而积极应对全球气候变化。 New energy patent fast application system is the key method for promoting the innovation of green technology. However,due to the differences of examination standard and object,the effect of this system is not very desirable so that the basic aim of this system cannot be realized. So,starting from the aspect of promoting the new energy technology innovation,it is necessary to enlarge the scope of examination object,clear the examination standard and add reasonable process restrictions and global green patent highway in order to provide a uniform model for intellectual property administration offices in each country and eventually solve the global challenge of climatic change.
