试论我国精神疾病司法鉴定面临的问题

Discussion on Issues of Forensic Psychiatric Evaluation in China

根据就南京宝马撞车案引发的社会舆论,提出我国精神疾病司法鉴定当前面临的七个方面问题:精神疾病司法鉴定启动权;精神疾病司法鉴定机构和鉴定人的鉴定资质;精神疾病司法鉴定程序;精神疾病司法鉴定的诊断;精神疾病司法鉴定责任能力的评定;精神疾病司法鉴定人的法律地位;受害者的社会救助和保护社会。通过对这几个问题存在的现状进行讨论,提出改进策略和建议;在讨论最后一个问题时,特别强调了采取积极措施,加强对受害人和其家属社会救助的重要意义;以及保护社会不受具有暴力倾向的精神病人侵害的七项措施,把保护社会与保护精神病人统一起来,对平息公众舆论,建设和谐、文明社会具有更深远的作用。

The Nanjing BMW motor vehicle accident has caused intense discussions and arguments among the Chinese public. The author addresses the 7 major challenges in forensic evaluation of mental disorders： the right of initiation of forensic evaluation of mental disorders; the qualification and experience of the forensic psychiatric institutions and experts; the procedure for forensic evaluation of mental disorders; the diagnosis of mental disorders during forensic evaluation; the forensic evaluation of liability and criminal responsibilities of clients with mental disorders; the legal status of forensic psychiatric experts; and the service for the victims and protection of the community. The author discusses the current problems of forensic psychiatric evaluation and makes some suggestions. Seven measures would be explored in order to protect the victims and their family members, and to stay away from the assault of mental patients with violent tendencies. Such actions would not only help to protect community and patients with mental disorders, but also have important and profound implications for relieving public worries, as well as building up a harmonious and civilization society.
