我国建立环境责任保险制度的探析——新《环境保护法》第52条思考

环境责任强制保险作为一个新兴发展的领域,是伴随着近几十年来严重的环境问题而衍生出来的。这项制度是平衡投保人、保险人和受害第三人利益的最佳举措,也是解决我国目前存在大量企业污染而政府买单的情况。文章主要从新修的环境保护法对于环境责任强制保险制度设立的必要性和可行性,以及借鉴国外先进经验和结合我国国情,对环境责任强制保险制度中的法律关系主体和要素进行分析,从而对我国进一步设立环境责任强制保险制度的制度架构提出一些可行性的建议。

Environmental liability compulsory insurance,as a new domain,comes up with severe environmental problem in the latest decades. This system is the best way for applicants,insurers and victims to balance their interest,which is also a solution for China＇s problem that government has to pay for company- made pollution. The main point in this paper is about the necessity and feasibility of the establishment of compulsory insurance system in the new edition of environmental protection law. Considering the advanced experiences abroad and current situation in China,the subject of legal relation and factors are analyzed,based on which suggestions are proposed.
