摘要
文章介绍了宅基地使用权转让实践进展、特点及效果,宅基地转让过程中存在有违现行主流立法理念、冲击现行宅基地使用制度、流转基础不牢固、所有权主体利益无法保证等问题。基于宅基地使用权流转禁而不止的实际,提出应开展宅基地使用权转让试点,探索逐步实现宅基地使用权转让的市场化,并从推进宅基地确权登记发证、建立农民住房保障制度、健全村级民主管理制度等方面提出促进宅基地使用权转让的配套支持政策。
This paper analyses the problems that we face in the process of the transfer of right to the use of house site. The main problems include: violation of current mainstreamlegislation idea,the impact of the current land use system, weak transfer base, no guarantees for ownership subjective interests. In light of this, this paper points out that pilotwill be launched forthe transfer of homestead land use rights so as to find the ways to realize the marketization of land use right transfer. In addition, related support policies are also proposed with a view to promoting the transfer of right to the use of house site. These policies must be considered from the following aspects: promoting the work with regard to the right verification, registration and certificate issuances of homestead; establishing the housing security system of the farmers;and improving village-level democratic management system.
