Lin Zexu and International Law:the Fictional and the Actual

受史观等因素的制约,现有关于1939年林则徐翻译国际法一事的研究,并不能令人满意。对林则徐翻译并运用国际法一事,需要以更为实证和客观的态度来研究。简要的文本考察表明,林所组织翻译的国际法文本质量堪忧,这影响了林则徐将国际法作为以理服人工具来使用的实效。对具体交涉过程的分析表明,国际法在鸦片战争时期林则徐对外交涉中所起作用微乎其微。在很大程度上,林则徐对外交涉的主导理念仍是传统的华夷秩序观。在回顾中国融入国际社会的过程时,有必要检讨中国自身所犯的错误。在总结错误的基础上,民族才能获得进步。

Limited by the concepts of history and some other factors,current studies about the translation of international law by Lin Zexu can not be said as satisfactory.This historical event needs to be reaserched in a more positive and objective manner.A brief examination of the texts of this translation shows that the quality of the texts needs to be further improved,which influeced the real effect of interational law as a tool of persuading foreigners by Lin Zexu.An analysis of the concrete negotiating process demonstrates that international law played hardly a role in the foreign affairs during the period of the first opium war.The main idea regulating the foreign affairs by Lin Zexu was still to a great extent the traditional Chinese world order view of Hua and Yi.While reviewing the process of China’s entrance into the family of nations,it is of great necessity to analyse the errors which China herself had made.Based on the lessons of errors in the history,this nation could finally make progress.
