正当防卫若干问题探讨

Several questions on justified defence

本文主要分析了一般防卫的限度和特殊防卫的限度,以及特殊防卫权确立的理念。认为大幅度放宽防卫的必要限度,未必能极大地调动群众与犯罪分子作斗争的积极性,而且特殊防卫权的确立,不利于对不法侵害人的利益保护。本文还认为,特殊防卫权中,在防卫人防卫之前就唤起公民使用极端的手段进行防卫的意识,这在当今文明社会中,从理论角度上讲是不道德的。

The limitation of the general defence and special defence and the idea about the establishment of the special defence right were analysed mainly in this text.In the author's opinion ,relaxs the essential limitation of defence by a large margin may not necessarily arouse the enthusiasm that the masses struggle against criminal greatly.Moreover,the establishment of the special defence right is unfavourable to protect the interests of the unlawful infringer.This text thinks that special defence right arouse the citizen's consciousness that use the extreme means to defend before the defender take actions.It is also immoral from the ethics angle in the civilized society nowadays.
