摘要
大学章程是学术自由的制度性保障,是大学自治的载体。大学章程具有特殊的法律属性,具体来说,大学章程具有行政法性、契约性及自治法性等属性。作为一种具有法律属性的文件,在国家法律精神的指导下,大学章程涉及高校办学、使命、定位、内部管理体制等问题,为高校体制及机制改革指明方向。
The university charter is the institutional guarantee to academic freedom and the carrier of university autonomy. The university charter has special legal attributes, to be specific, having administrative nature, contractual nature and other autonomy law nature. As a document with legal attributes, and under the guidance of the national spirit of law, it gives direction for the system and the mechanism of university in the mission, positioning, internal management system and other issues of universities.
