摘要
我国劳动法学界对无效劳动合同的讨论是一个动态的过程,大致存在绝对无效说、引入相对无效说与关系性契约说三种学说,并不存在王硕博士在《劳动合同无效解除制度的理论反思》一文中所说的"无效合同解除说"(载《北方法学》2015年第2期)。三种学说不仅存在着学术争鸣,还与《劳动法》、《劳动合同法》两次立法活动产生互动。在劳动合同效力需要弹性化且劳动合同不应适用自始无效的认识之上,《劳动合同法》与劳动争议司法解释均未对已经存在的事实劳动关系采取可撤销的处理方式,王硕博士认为这样的制度安排存在结构性的疏漏,但其实这样的制度选择具有逻辑与现实上的必然性。
