利益分析视角下解构与衡平环境利益的思索——以邻避冲突中的利益失衡分析为例

Thinking on Rule of Law about Balancing of Environmental Interest in the NIMBY Conflict

环境利益失衡会导致社会各项利益的冲突,继而引发社会的不稳定,以邻避冲突为例,其破坏了社会的进步和发展。运用利益分析理论工具对邻避冲突中的各项利益进行解构,发现环境利益在群体利益、社会公共利益和公主体利益等层面存在失衡。继而提出衡平环境利益的法律对策:提高群体环境利益表达的有效性,采用衡平环境利益的多元化方法,并重视和保障公主体的环境利益。

Imbalance of environmental interests lead to conflicts in different field. Take the NIMBY conflicts as a example, we find it block the development of society. We analyses and disassemble the interests in NIMBY conflict using interest analysis tools and find the environmental benefits are imbalance which is in the collective interests, social interests and public interests. Analyzing its reason, we put forward some suggestions of balancing these environmental interests. We must pay attention to enhance the way of express of collective interest, to measure the level of environmental benefits using the multiple method, and to improve the notice degree of the public interest.
