State Governance and the Development of Public Law:Age Topics of Chinese Legal Modernization

公法发展与国家发展和国家治理内在相连,国家与社会的关系亦构成公法调整的主要对象之一。公法发展的历程记录了国家发展及其现代化进程的演进轨迹,反映了不同历史时期国家与社会之间关系的变动特点。自近代以来,伴随着国家与社会的发展进程,中国公法发展经历了三次转型。20世纪初晚清十年政制改革及至1911年的辛亥革命,促进了中国公法领域的第一次转型。1949年新民主主义革命的胜利,创设了新型国家治理体系,由此展开中国公法的第二次转型发展。1978年中共十一届三中全会开启了创新中国国家制度与国家治理体系的时代进程,遂而形成中国公法发展的第三次转型。推进国家治理现代化这一重大战略性目标的提出与实施,为当代中国公法发展提供了强劲动力。以中共十八大和十八届三中、四中、五中全会为标志,中国公法发展进入了一个革命性变革的历史新时期。在当代中国,深入探讨国家治理现代化进程中的中国公法革命的基本理论与实践问题,藉以把握中国法治现代化运动规律,是时代赋予中国法学工作者的学术使命。

The development of public law internally relates to the development of state and the state governance. The relationship between state and society also constitutes the main object of publiclaw adjustment. The development of public law, records the evolution path of state development andits modernization process, reflects the different characters of relationships between state and society indifferent historical periods. Since modern times, with the development of state and society, China'spublic law has undergone transformation for three times. Ten years of political system reform in thelater Qing dynasty of China and the 1911 revolution made the first transformation happen. The victo-ry of China's New- Democratic Revolution, which created a new state governance system, promoted the process of the second transformation of China's public law. The third transformation came to betrue with the Third Plenary Session of the 11 thCPC Central Committee. To promote the modernizationof state governance, as a great strategic goal, supplies strong impetus for the development of Chinesepublic law. The Third, the Fourth and the Fifth Session of the 18 thCPC Central Committee marked anew historical period of revolutionary change for Chinese public law. In contemporary China, weshould further discuss the basic theoretical and practical problems of Chinese public law revolutionin the process of promoting the modernization of state governance, whereby grasp the movement ruleof modernization of Chinese rule of law. This could be the academic mission of Chinese legal sci-ence worker given by this era.
