互联网经济犯罪侦防应对研究

A Research on the Investigation and Prevention of Internet Economic Crimes

作为经济犯罪的重要形式,互联网经济犯罪既包括传统的利用网络作为犯罪渠道或手段的侵犯知识产权类犯罪、网络诈骗犯罪、网络传销犯罪,也包括在网络与经济深度融合过程中滋生的互联网金融犯罪、网络非法经营犯罪,并因兼具网络与经济双重属性,从而具有以网络平台为载体、犯罪成本低、涉及对象广、技术手段规避侦查、犯罪成员分布国际化等特点。对此,需从侦、防两方面着力,既要情报先行带动已发案件侦查,提高线索信息利用效率和电子数据取证水平,又要从完善立法体系、健全网络征信、提高预警防范、加大教育宣传等方面下功夫,铲除滋生互联网经济犯罪的土壤。

Being an important form of economic crime, internet economic crimes include infringement of intellectual property, network fraud crime, network pyramid selling crime, internet financial crimes and internet illegal business crime. Due to the dual attributes, internet economic crimes have such characteristics as applying network platform, low cost, wide range of victims, adopting special technical means and international distribution of criminal suspects. Therefore, we have to focus on both investigation and prevention of internet economic crimes. In the field of investigation, we have to depend on the dominant factor of intelligence technology in crime investigation and improve the utilization efficiency of the information leads as well as the level of electronic data forensics. In the field of crime prevention, we have to make progress in improving the system of laws and regulations, consummating network creditgrading mechanism, ameliorating crime warning and strengthening publicity to eradicate internet economic crimes.
