摘要
本文通过分析山东省莱阳市开发的以莱阳梨承包经营权为抵押的"梨农贷"案例,发现土地承包经营权是两权抵押贷款的必要条件,但不充分。有效抵押尚需地方政府和人民银行在明确权力边界、便利市场交易等方面发挥作用。
This article analyzes the case of Laiyang pear farmers loans,and finds that the land contract and management rights is a necessary condition for the "Two Rights"(namely the land contractual management right and farmers housing property right) mortgage loan, but not sufficient. Effective mortgage still need local government and the PBC to play a role in clearing the power boundaries and facilitating market transactions.
