论法治视域下涉诉信访与司法救济的关系

On the Relationship Between Complaint Letters & Calls Involved in a Lawsuit and Judicial Relief in the View of Rule of Law

涉诉信访作为一类针对法院诉讼活动的特殊信访,已逐渐发展成为司法救济的"再救济"途径。导致涉诉信访泛滥的原因很多,其中一个重要原因是现有的司法救济不力。不容否认,涉诉信访在监督司法救济方面存在积极作用。但长远来看,现有的涉诉信访将严重折损司法权威,不利于司法救济的法治化建设。重构涉诉信访与司法救济的关系不仅需要涉诉信访与司法救济的改革互动,也需要一系列制度的配套调整。其中改革的核心点在于提升司法救济的权威与转变涉诉信访的功能。

The complaint letters and calls involved in a lawsuit is a kind of special petition concerning court proceedings,which gradually developed into a special remedy for the judicial relief.There are many reasons leading to so frequent complaint letters and calls involved in a lawsuit,and one important reason is the lack of sufficient judicial relief.There is no denying that the complaint letters and calls play apositive role in supervising the judicial relief.But in a long run,this kind of complaint letters and calls would wreck the judicial authority and harm the construction of judicial relief under the rule of law.Reconstruction of the relationship between complaint letters and calls and judicial relief requires not only an interactive reform of the two systems,but adjustments of a series of supporting systems.The core to the reform lies in improving the authority of judicial relief and transforming the function of complaint letters and calls involving in a lawsuit.
