试论国防和军队改革的司法保障

On the Judicial Support of National Defense and Military Reform

"深化国防和军队改革"是党的十八届三中全会《决定》确立的全面深化改革的重要任务。在推进国防和军队改革的过程中迫切需要军事司法机关提供有力的司法保障。但是,军事司法机关自身的体制机制改革则是提供上述司法保障的重要前提。当务之急,应当着力做好明晰军事司法的权力性质、推进军事司法的顶层设计和完善军事司法的管辖制度三项工作。

Deepening the reform of national defense and army is the important task of deepening reform comprehensively established in the Decision of the Third Plenary Session of the 18 th Central Committee of CPC. Meanwhile,in the process of promoting national defense and military reform,it urgently needs to provide a strong judicial protection by military justice. But,the important premise is the reform of the system of military justice organs.Now the top priorities are three tasks： clarifying the power character of military justice,promoting top- level design of military justice and perfecting jurisdictional system of military justice.
