摘要
通过区分教学自由与言论自由可以探讨教学自由的范围与界限。教学自由是宪法确认的基本权利,它是社会基本权而非言论表达自由,是教师在教学场所传授专业知识的权利,属于非政治表达的范围。教师对专业知识和科学知识的选择和决定是教学自由的重要内容,它排除国家和社会组织的干涉,所以,教学自由被限定在专业知识领域内。教师不得在课堂教学中进行政治表达,其言论自由只能在开放式的公共领域内展开。
It discusses the extent and limitation of teaching freedom through discrimination teaching freedom from freedom of speech.Teaching freedom is the basic rights confirmed by the Constitution,but not freedom of speech;it is the right that the teachers have during teaching the professional knowledge in teaching place;also,teaching freedom is nonpolitical expression.Teachers＇ choices and decisions about professional and scientific knowledge are the core content of teaching freedom,and the states and social organizations cannot intervene in them,so teaching freedom is limited in the extent of professional knowledge.Teachers cannot provide political expressions in the class,the freedom of speech that teachers have is only permitted in the field of open and public places.
