对未成年人犯罪适用罚金刑的思考——以西宁市为例

Thinking and Research on the Application of the Fine Penalty to the Juvenile Delinquent——Taking the City of Xining as an Example

对于罚金刑在未成年犯当中的适用,我国刑法及相关解释中没有做出明确具体的规定。因此,对未成年人犯罪适用罚金刑的研究在实践中具有重大的意义。文章以西宁市为例,从对未成年人犯罪适用罚金刑方式的多元化,罚金刑的确定标准以及执行程序等方面提出相应的对策。

In China, the crime rate of the juvenile delinquent is rising year by year, and the age ot me criminals tends to be younger. At the same time, the application of the fine penalty to the juvenile delinquent exposes some problems and there are not any specific provisions in the criminal law related to explanations. Therefore, it is significant in practice to do some research about this topic. In order to make up for deficiencies of the fine penalty, this paper proposes corresponding countermeasures in according with the present situation and problems on the application of fine penalty to the juvenile delinquent in Xining, which includes diversified fine penalty to the minors and exact standards and proper programs.
