加强职业团体立法是法治社会建设的有效途径

Legislation of Vocational Groups Is the Effective Approach of Legal Society Construction

中国经济和社会的发展进步需要发挥职业团体的组织功能,加强职业团体立法能够为实现社会管理提供一个法治化管理路径,但我国现有的立法体例既在指导思想上滞后,立法层次也不高。因此,以社团立法为依托,形成职业团体立法一般法,同时,对一些职业人口多、团体规模大的职业团体进行单行立法,形成职业团体立法的特别法,不失为法治社会建设中发挥职业团体的组织功能的有效办法。

The organizational function is needed in the process of China＇s economic and social development. Strengthening the legislation of vocational groups can provide the social management with a legal approach. But the current legislation of vocational groups is not only backward in guiding ideas but also low in legislative levels. So,we should construct general laws of vocational groups on the basis of legislation of mass associations and at the same time construct the special laws of vocational groups through separate legislation of large vocational groups with a great number of members,which may be an effective way to give full play to the organizational function of vocational groups in construction of legal society.
