The Protection of Tibetan Medicine in the View of Sociology of Law

藏医药的保护,既包括在传统藏医药基础上研制成功的藏医药新产品的保护,更包括对作为文化遗产的传统藏医药本身的保护。对于前者,现有的知识产权法律体系将继续发挥作用,而对具有深厚佛教文化渊源的传统藏医药本身的保护,不仅面临现有知识产权体系的制度瓶颈,更面临现代法治与传统文化之间的冲突。作为传统知识的藏医药构成人类文化遗产重要的组成部分,应被看作文化权利的客体并视为环境保护的一部分加以保护。

The protection of traditional Tibetan medicine includes the protection of those new pharmaceutical products based on traditional Tibetan medicine as well as traditional Tibetan medicine itself. To the former,present intellectual property laws shall keep on playing their role,whereas traditional Tibetan medicine itself is confronted not only with the bottleneck of present intellectual property system but the conflict between modern law governance and traditional culture due to its deeply- rooted Buddhist tradition. Tibetan medicine as traditional knowledge is the inalienable constituent of human cultural heritage and should be treated as a part of environmental protection and the object of cultural rights.
