摘要
被诉人自主辩护其实天然地具备确定的正当性和诸多的诉讼价值。在社会律师辩护、法律援助等辅助辩护的普遍性及有效性均存在较大问题的司法现实条件下,强调保障有效发挥自主性辩护尤其具有积极的向度意义;再者,即使将来刑事辅助辩护覆盖率及有效性有很好的提高,被诉人自主辩护也同样具有不可替代的价值。
Defendant＇s independent defence system is naturally provided with legitimacy and contentious values.In the community of counsel,the universality and effectiveness of legal aid there is a big problem of judicial realistic conditions,emphasizing the autonomy to protect effectively play defense in particular has a positive dimension litigation significance.
