土地产权制度与管制制度的制度均衡分析

An Institutional Equilibrium Analysison Land Property Rights System and Regulation System

以均衡制度观的视角审视中国土地产权制度与土地管制制度,分析土地产权制度与土地管制制度的现状及特征,并深入探讨土地产权制度与土地管制之间的关联及其对土地制度演进的影响,以期为当前的土地制度改革提供方向性启发。研究显示:(1)在市场经济导向下,土地产权制度与土地管制制度在公共资源域与交易域存在正向互补的稳态均衡;(2)当前的中国土地产权制度与土地管制制度是一个非市场导向的次优制度安排,制度均衡呈非稳态特征;(3)土地产权制度与土地管制制度的演进变迁是相互联动的,而且制度变迁面临着多种可能,难以实现自我强化并发挥稳定的制度功能。结果指出中国的土地制度改革需要以土地市场化为导向,考虑土地制度的整体性特征,并有相应的顶层设计予以支撑。

In order to specify a right direction for the current land system reform with the institutional view of game equilibrium,this paper analyzed the current situation and characteristics of land property rights system and land regulation system. In addition,the relationship between land property rights systemand land regulation and its influence on the evolution of land system were discussed, The results showed that 1) under the orientation of market,the land property rights system and the land regulation system display a positive complementary steady equilibrium in the public domain and the transaction domain; 2) at present,China's land property rights system and land regulation system are a non- market oriented sub- optimal system,which is characterized by non- steady state characteristics. 3) the evolution of the land property rights system and the land regulation system are the mutual linkage,but the land system evolution is faced with many possibilities,and in the land system,self enhancement is difficult to realize,so as unable to play a stable system function. The results indicated that the land system reform in China should be market- oriented and take the overall characteristics of the land system into account,and the support of corresponding top- level design is needed.
