宋代民间借贷信用监管机制初探——从社会转型背景切入

Preliminary Study on the Supervision to the Credit of Private Loans in Song Dynasty——From the Aspect of the Social Transformation

信用是维系社会持续发展、交往秩序稳定和制度正义认同的本质条件。信用失坠的根本原因在于社会转型引起的价值观念多元化。宋代社会正处于这样的转型时期,其时民间借贷面临着较为严重的信用危机。为了恢复和维护民间借贷关系中的信用,两宋时期各级官府和政治精英注重运用道德教化和法律规制两个方面的调整手段,维护民间资本交易和基层社会生活的秩序。宋代德法协调的信用监管机制,对当代中国的相关制度建设具有积极的借鉴意义。

As the essential condition in keeping the societyb sustainable development, the stable order of the social interaction and the identification to the institutional justice, the credit will be absent in the case of values＇di- versification as the product of the social transformation. In the period of Song Dynasty, the society of which was confronted with this kind of transformation, and suffered from the severe crisis of the credit of private loans, the government was trying to strengthen the systems of moral education and legal regulation, so that the credit of the private loans would be restored, and the order of private capital transaction and grass - root social life could be maintained. It can be concluded that the credit supervision system based on the integration of morality and laws in Son~ Dynasty has significant reference to the contemnorarv China.
