事业组织获得真正意义上的法律人格是我国事业单位改革的目的之一。公立高校作为履行公共服务职责的事业组织之一,明确其公法人地位以及构建合理的法人内部治理机制,对于建立现代大学制度具有十分重要的意义。在这方面,法国公务法人制度、公司等私法人治理结构中的内部权责分配与监督制约机制提供了制度借鉴。
