摘要
服务合同是继续性合同,其履行具有信息不对称的特点。为了维护交易安全、保护信息弱者、突出服务的"定制"个性,必要的通知、协助义务是服务合同目的的要求。服务合同履行具有过程性和双向性。服务瑕疵的认定应当从过程质量和结果质量两方面入手,具体表现为合同义务群的履行情况。在约定优先的前提下,以合同过程为线索,构建以先合同义务、过程义务和结果义务为框架的服务合同义务群体系。过程义务具有一般性、必要性,结果义务具有特殊性、选择性。
Service contracts are continuous contract,with information asymmetry in their performance.In order to preserve the transaction security,protect the weak of information,highlight customization characteristics of service,it's necessary to inform and cooperate as required by the purpose of contract.The performance of service contracts is procedural and bidirectional.Defects of service should be affirmed from both process quality and result quality,which embody in the performance of contractual obligation group.Service contract obligation system contains the framework of pre-contractual obligations,process obligations and result obligations with priority of agreement as the premise and contractual process as a clue.Process obligations shows generality and necessity while result obligation shows particularity and selectivity.
