The Ability of the Criminal Law

刑法能力是刑法伦理、刑法品格、刑法质量、刑法环境、刑法方法、刑法效能的综合反映,是指刑法在生成、运行中所发挥的能量,包括内在能力和外在能力。其中前者可分解为刑法的规范能力、刑法的宣示能力、刑法的自我调节能力;后者主要有刑法的标识能力、刑法的普及能力、刑法的协调与应变能力、刑法的重构与整合能力、刑法的适用能力等。能够体现刑法规范生命力和时代感的是刑法的创新能力,包括刑法的科学化能力、刑法的理念革新能力、刑法的体系调整能力。刑法能力理念强调刑法积极参与社会管理的实践性、能动性和创新性。刑法生成能力、刑法运行能力和刑法创新能力构筑了刑法能力体系的主体部分。

The ability of the criminal law is the comprehensive reflection of criminal law ethics,criminal law character,quality of the criminal law,environment of criminal law,methods of criminal law and efficiency of the criminal law. It is the ability to play in the process of criminal legislation and criminal justice,including internal and external aspects. The former can be decomposed into regulating competence,declare ability and selfregulation,while the latter includes identification ability,popularization ability,coordination ability,strain capacity,refactoring capability,integrating capacity and applicable ability. The innovation ability of the criminal law can reflect its vitality and modernity. This concept emphasizes practicality,initiativity and creativity of the criminal law. The generation,operation and innovation capacity of criminal law constitutes the main part of the ability of the criminal law.
