摘要
从维护公众生命健康与公民人身自由权的冲突,维护公众生命健康与公民个人隐私权的冲突,维护公众生命健康与公民其他个人权利的冲突三个方面论述了冲突的产生,简述了权利的平衡和冲突的解决需要卫生法律制度的保障。同时,针对存在的问题提出以下建议:完善限制公民个人权利相关的法律规定;规范限制公民个人权利的行政程序;完善权利被限制公民的法律救济。
Tenance of public health and the citizens＇ personal liberty, public health and the citizens＇ privacy, and public health and other personal fights. It also expounded that the balance of power and conflict resolution nee- ded the guarantee of health legal system. Simultaneously, aiming at these problems the paper brought forward the following suggestions： perfecting the related laws and regulations that limit citizens＇ personal fights; standardizing the administrative procedure; and perfecting the legal remedy of rights restricted citizens.
