权力清单制度中的公众参与研究——兼论权力清单之制度定位

从其行政自制之控权风格、具体内容及其承载的功能来看,权力清单应被定位为行政规则。在此前提下,权力清单制度中的公众参与模式必然受制于行政规则和公众参与本身的特点。在具体的模式选择中,行政机关应以"质量要求"和"可接受性要求"为基本的考量要素,根据具体情形并结合权力清单的类型,在"公众参与的有效性模型"之下的五种类型之中做出选择。

The accurate positioning of power list system is the premise to determine the mode of public participation in practice. From the control style of administrative control,specific content and the function of bearing,power list should be positioned as the administrative rules. Under this premise,the public participation mode in the power list system is bound to be subject to the characteristics of the administrative rules and the characteristics of public participation itself. Of course,in specific mode selection,the administrative agency still should have a set of selection criteria,which is based on the ＂quality requirements＂and ＂acceptable requirements＂as the basic factors of consideration,according to the specific situation and the type of power list,make a choice in the five different types of participation under the model of the effectiveness of public participation.
