摘要
2014年11月,全国人大常委会对现行行政诉讼法作出了大篇幅的修改,司法机关有权对规章以下规范性文件进行审查。然而针对具有普遍约束力的行政规范的司法审查,这次行政诉讼法的修改仍然遗留了不少问题,如检察机关不能成为启动司法审查的主体、法院的审查不具有最终效力等。论题在借鉴了域外司法对规范性文件的审查制度后,对我国新行诉法下的司法如何有效地审查规范性文件提出了针对性建议,以期能对我国司法机关有所帮助。
In November 2014, the NPC Standing Committee made great revision on the current administrative procedure law, and the judicial authorities have the right to review the following normative documents. However, there are still a lot of problems in the revision considering the judicial review of universally administrative binding norms, i.e. procuratorial organs can not be the subject of starting judicial review, and review of the court does not have the ultimate effect, etc. By drawing lessons from overseas judicial review system, the paper proposes relative suggestions to improve our judiciary.
